Batavia Air Fulfill Bankruptcy


Central Jakarta Commercial Court decided to grant the aircraft leasing company , International Lease Finance Corporation (ILFC), which sued bankrupt as operator PT Metro Batavia airlines.

"To grant the applicant's request for all," said the chief justice, Agus Iskandar, when reading the verdict on wednesday.

The judges declared eligible Batavia Air is declare bankrupt, in accordance with law No.37/2004 on bankrupty. "It has been qualified bankrupty, so that the request can be granted," said Iskandar.

Batavia Air had also been planning to bring 12 aircraft Airbus A-320, a fleet of 38 aircraft to strengthen (15 Boeing B-737-3003, Nine Boeing B-737-400, a Boeing B-737-500, 1 Airbus A-321, 10 Airbus A-320 and two Airbus A-330).

The ruling, the Batavia Air is stated to thing aboun whether to accept it or not, forwarded an appeal. "According to Article 11 paragraph 2 of the bankrupty act, we have the right to seven days to file an appeal or not," said attorney Batavia Air, Chess Wibowo.

Actually, ILFC has revoked the lawsuit shortly before the verdict was read to the judges, but the Batavia Air demur because revocation made during the trial has entered the final round, whch is ahead of the verdict.

Batavia Party revealed, bankruptcy has made his reputation tainted and damaged public confidence.

With the repeal of thi lawsuit, the judge suspend the reading of the verdict should be approximately at 11.00 pm to 16.00 pm to facilitate the deliberations of the plaintiff and defendant.

Some of the past, ILFC do file bankruptcy against Batavia Air for nonpayment of dept maturing until December 13, 2012, reaching 4.68 million U.S. dollars.

Debt was coming from the obligation to pay rent, reserves, and late payment interest, In addition to ILFC, Batavia Air also reported to havea bill to Sierra Leasing Limited, which is also derived from aircraft lease agreements.

Batavia Air has declared payable to both parties ILFC and Sierra Leasing Limited has much as 9.63 million U.S. dollars. Originally Batavia Air was reportedly acquired by Air Asia, but canceled.
